Kristen Dulysh

Kristen Dulysh began her work in the criminal justice system when she completed an internship at the Ontario Correctional Institute while she was earning her degree in Criminology. Working closely with an incarcerated population in a rehabilitative setting allowed her to understand early on that no person should be defined by their past mistakes. She is now an associate and is determined to give her clients their best defence to the charges they are facing.

Kristen graduated with high distinction with her Bachelor of Arts with Honours from the University of Toronto. She then attended Osgoode Hall Law School where she obtained her Juris Doctorate. During law school, Kristen was a case worker at the Innocence Project where she assisted with an application to the Criminal Conviction Review Group (CCRG) for ministerial review. She also completed an internship at the Ontario Court of Justice in Brampton where she shadowed provincial court judges and provided research assistance.

Before joining Derstine Partners, Kristen was a summer student at Mirza Kwok Criminal Defence Lawyers. She completed her articles of clerkship at Alan D. Gold Professional Corporation. As a student, Kristen was able to assist with a number complex cases in the Ontario Court of Justice, Superior Court of Justice and Court of Appeal.

Noteworthy Results: 

1. R. v. Y.R. 2020 – client was a personal support worker who was alleged to have used the client’s debit card without his permission to withdraw hundreds of dollars on several occasions. Client was charged with several counts of theft under $5000. After the cross-examination of the complainant, client was offered a peace bond. 

2. R. v. Y.B. 2021 – client was charged with possession of cocaine for the purpose of trafficking after cocaine was located in a backpack in a vehicle. Drugs were excluded as a result of section 10 (b) violation. 

3. R. v. H.S. 2021– client was a massage therapist and was accused of sexually assaulting client. He was acquitted. 

4. R. v. A.M. 2022 – client was charged with assaulting and sexually assaulting his former wife while they were married. He was acquitted of both charges. 

5. R. v. A.B. 2022 – client was charged with sexually assault a friend who had come over to his house to hang out. Client was acquitted. 

6. R. v. N.S. 2023 – client was charged with forcible confinement and theft under $5000. After the cross-examination of the complainant, the Crown invited an acquittal on the forcible confinement. Judge acquitted of the theft under $5000 because he was left with a reasonable doubt as a result of issues with the complainant’s testimony. 

7. R. v. M. S. 2023 – client was charged with sexual assault. The complainant was his friend who was intoxicated and testified that she woke up to the accused having sexual intercourse with her. The client was acquitted.  

8. R. .v D.F 2023 – client was charged with a series of offences related to possession of a loaded firearm based on the fact that his fingerprint was found on the firearm. The client was acquitted of all charges.
